The information we collect: During the course of your shopping experience, we collect personal information required to process orders such as your name, company name and shipping information. Shipping information is never given to any other company except as required for shipping your orders. Your email address is required as a login name and is used to send information about your orders.  We will NEVER sell the information you provide us for any reason.

Misprints and errors on our website: We endeavor to provide current and accurate information on our website. Nevertheless, errors and misprints may occur. Accordingly, we reserve the right to reject, correct, cancel or terminate any order for goods or services for which the price was incorrectly displayed or where we otherwise displayed erroneous or inaccurate information. Chotski.com reserves this right at any stage of the online ordering processing, including after an order has been submitted and whether or not the order has been confirmed and your credit card charged. If your order is cancelled and your credit card has already been charged, we will issue a credit to your credit card account in the amount of the charge. Individual bank policies will dictate when this amount is credited to your account. To provide you with a credit, where applicable, is our only obligation to you.  Chotski.com is not obligated to sell products or services based on errors or misprints on our website.

Setup Charges: apply to all imprinted orders except for exact re-orders. Ask us about rush charges if your due date is sooner than the standard production time allows. Please also keep in mind that production time is in business days, and does NOT include weekends, time for order processing, art approval, or shipping. 

Minimum Quantities: In some cases, even lower minimums may be available than that stated in the catalog - please call us to see if a particular item is available at less than minimum.

Blank Goods: Most promotional items in our line are available blank (no personalization). In most cases, these products are available under the minimum imprinted quantity and sometimes are offered at a lower price. Call us for more information.

Imprint Colors & PMS Matches: Each item that we offer is available with standard imprint colors. These colors vary from item to item, but we strive to provide generally accepted variations of the most popular colors. If you want us to match your organization's exact color(s) and they are not an offered standard, we can offer this service on most products for a nominal charge. Call us to place orders with specific PMS (Pantone Matching System) color match requirements.

Imprint Methods: Depending on the item, a specific method is used to produce the best look for your logo or messaging. In some cases, you will be offered a choice of methods. The most popular decoration choices for our promotional products include:
Screen Printing, Pad Printing, Foil Stamping, Foil Embossing, Laser Engraving, Offset Printing, Silk Screening & Embroidery.

Art Instructions: We request that you send at least 300 dpi (dots per inch) vector artwork saved in EPS format. If you are not sure about how your logo or art is saved, send us what you have and we will advise as to its usability. If you choose an item with a process color imprint or multi-color embroidery, please send a sample of the logo in full color with your art files so we have a point of reference. Acceptance: By your submittal of an online order and/or your signature on our Order Acknowledgment is a conditional acceptance by chotski.com of your offer to purchase our goods and your acceptance of our terms and conditions. It may contain terms that differ from, or add to, those contained in your purchase order, should you have one, and to the extent that this is the case, Chotski.com hereby expressly conditions its acceptance of your offer on Chotski.com's assent to the additional or different terms. Your receipt and retention of the goods covered by this invoice shall constitute acceptance of any such additional or different terms. You and Chotski.com agree that any contract hereby entered into has been made and is to be construed to California Law.

Ownership: of all goods passes to you, the customer, once we deliver them to the carrier. Chotski.com cannot be held accountable for delivery delays due to acts of God, or other circumstances beyond our direct control.

Returns: While we make every effort to provide you with the finest quality products, mistakes can sometimes happen. If you have any problems with your order please contact customer service within 5 days of receipt. We advise opening your merchandise to review its quality if you do not intend to use it right away. After this time we will be unable to go back to our suppliers for credit. Please have your order number available. WE DO NOT ACCEPT UNAUTHORIZED RETURNS. If any problem arises, please call customer service immediately. If necessary we will issue an RMA number (Return Material Authorization) and provide you with a special shipping address.

Over and Under runs: We try to produce your order to the exact quantity ordered; but this is not always possible due to quality control efforts and fast running machines. We reserve the right to ship and subsequently bill or credit, your charge card or account, for up to 10% over or under the desired quantity.

Merchandise Consistency: Please note that we encourage you to take the opportunity to review a sample of the actual product before you order in bulk quantity. It is important that you understand that these samples are representative in nature. While we are very careful about the suppliers and manufacturers we use, manufacturing variations are unavoidable and a natural result of the manufacturing process. By choosing to place and order with Chotski,com, you are agreeing to accept merchandise with reasonable manufacturing variances in product material, color and packaging. The most common example of this is apparel dye lots.

Cancellations and Alterations to Existing Orders: Once an Order Acknowledgment is approved, we cannot guarantee our ability to make changes or cancellations to an order. Chotski.com will make every effort to comply with your cancellation request. If you have already signed your Order Acknowledgment, there will be a minimum charge of $50.00 to cover order entry and preparation expenses. In addition, you are liable to pay the agreed upon price for any work in progress that may have been completed up to the time that we are able to cancel your order. These charges may include but are not limited to setup charges, artwork preparation charges, shipping charges and restocking fees. All completed work and costs incurred will be the responsibility of the customer.

Sales Tax: Chotski.com is required by law to collect all applicable state and local taxes for services and goods shipped to California. Customers in other states may be required to remit use taxes. Please consult your tax advisor. Companies, individuals and organizations who are exempt from sales tax should provide us with a copy of their resale certificate by fax to 650-738-1716 prior to placing the order.

Copyrights & Trademarks: By submitting a design to Chotski.com, you warrant and represent that you are the sole, legal owner or licensee of all rights, including copyright, to each copyright, trademark, service mark, trade name, logo, statement, portrait, graphic, artwork, photograph, picture or illustration of any person or any other intellectual property included in such design. Further you warrant and represent that no part of the design: violates or infringes upon any common law or statutory right of any person or entity, including, but not limited to, rights relating to copyrights, trademarks, contract rights, moral rights or rights of public performance; is the subject of any notice of such infringement you have received; or is subject to any restriction or right of any kind or nature whatsoever which would prevent Chotski.com from legally reproducing the images or text submitted. You agree to defend, at your sole expense any claim, suit, or proceeding brought against Chotski.com and it's suppliers which relates to, or is based upon, a claim that any portion of the design infringes or constitutes wrongful use of any copyright, trademark, or other right of any third party, provided that Chotski.com gives you written notice of any such claim and provides you such reasonable cooperation and assistance as you may require in the defense thereof. You shall pay any damages and costs assessed against Chotski.com pursuant to such a suit or proceeding. Further, you agree to indemnify and hold Chotski.com harmless from, and with respect to, any such loss or damage (including, but not limited to, reasonable attorneys fees and costs) associated with any such claim, suit or proceeding.
